Schmerzensgeld für Hinterbliebene jetzt gesetzlich geregelt

Das in der bisherigen Rechtsprechung anerkannte Schmerzensgeld für Angehörige wurde unter dem Begriff des „Schockschadens“ behandelt und war im Gesetz bislang nie eigens normiert. Nun findet sich eine gesetzliche Regelung in § 844 Abs. 3 BGB, die einen eigenen Schmerzensgeldanspruch für Angehörige vorsieht. Die gesetzliche Formulierung, die am 22.07.2017 in Kraft getreten ist, lautet:
„Der Ersatzpflichtige hat dem Hinterbliebenen, der zur Zeit der Verletzung zu dem Getöteten in einem besonderen persönlichen Näheverhältnis stand, für das dem Hinterbliebenen zugefügte seelische Leid eine angemessene Entschädigung in Geld zu leisten. Ein besonderes persönliches Näheverhältnis wird vermutet, wenn der Hinterbliebene der Ehegatte, der Lebenspartner, ein Elternteil oder ein Kind des Getöteten war.“
